A critical legal milestone is underway in Calgary this week as a murder case involving the fatal shooting of a young woman continues through preliminary inquiry proceedings at the Calgary Court of Justice.

Devon Bradley Malik is charged in connection with the death of his ex-girlfriend, who was shot in a parkade last summer. The preliminary hearing, which began Monday and is scheduled to run for five days, will hear evidence from an anticipated 19 witnesses as prosecutors build their case.

Defence Not Contesting Move to Trial

In a significant development, defence counsel Jim Lutz informed Justice Heather Lamoureux that he will not be challenging his client's committal to trial, meaning the case is expected to proceed to superior court regardless of the preliminary inquiry outcome.

Crown prosecutor Greg Piper and co-prosecutor Ryan Foran are presenting evidence to satisfy the low legal threshold required at preliminary inquiry—establishing that sufficient evidence exists for a jury to consider at trial. The burden of proof at this stage is considerably lighter than what will be required at the full trial.

Publication Ban Granted

The defence also requested a publication ban on evidence presented during the hearing, a common procedural tactic in preliminary inquiries. Justice Lamoureux granted the mandatory order, restricting public reporting on specific evidence details until a trial concludes or the case is otherwise resolved.

Preliminary inquiries serve as gatekeeping mechanisms in the Canadian criminal justice system, ensuring that cases proceed to trial only when reasonable evidence exists to support the charges. This hearing will likely determine the trajectory of the case as it moves toward the next phase of proceedings.
