A Calgary jury has begun weighing evidence in a high-stakes second-degree murder trial stemming from a brazen daylight shooting on a rural Alberta highway that left one man dead and another wounded.

Arthur Penner and Elijah Strawberry stand accused in the August 6, 2024 incident, which unfolded on a remote road east of Calgary and has gripped the region for nearly two years.

The Incident

Court heard that the shooting began when two assailants pulled up to power company worker Matthew Andres and shot him, leaving him wounded. The gunmen then commandeered his truck, but the vehicle became stuck on the rural road.

Minutes later, Colin Hough—a Rocky View County employee who had stopped to investigate the abandoned vehicle—arrived at the scene. Hough was fatally shot and his vehicle was taken by the suspects.

Crown's Case

Prosecutors have presented what they characterize as compelling circumstantial evidence, arguing that the facts overwhelmingly point to Penner and Strawberry as the only viable suspects. Crown lawyers contend the evidence creates an unmistakable portrait of guilt.

Defence Challenge

The defence team has mounted a different argument, emphasizing that the shooters' faces were concealed during the incident. Without clear facial identification, defence lawyers argue reasonable doubt persists about their clients' involvement.

Justice Shane Parker of the Court of King's Bench instructed jurors Friday to maintain an open mind and base their verdict solely on evidence presented during the three-week trial.

The jury's decision could determine whether Penner and Strawberry face lengthy prison sentences or acquittal—a verdict that has profound implications for Hough's family and the broader Rocky View County community.
